Terms and Conditions

Your use of the CubaATI website or purchase of any described product or services from AmericanTours International, LLC shall be deemed acceptance of these terms and conditions and specifically the limitation of liability set forth below. The terms "ATI", "we", "us", "our", "CubaATI", refer to AmericanTours International, LLC, a California corporation. The term "you", "traveler", "passenger" refers to customer booking a reservation and visiting the web site.

All CubaATI rates, taxes and information are subject to change without notice. Rates shown are either quoted in U.S. dollars (USD) or Cuban Convertible Peso (CUC) and are accurate at time of publication and are subject to accommodations availability. Rates may vary based on the actual date of travel, class of service, hotel or room category booked. Prices and conditions of reservation may vary for travel during holidays and peak periods. Prices quoted for single, double, triple or quad as requested by traveler are subject to availability. Proper identification required. Rates are based on the minimum requirement of one adult per room. Age requirement for check-in may vary from 18 to 21 years old, depending on location. Prices include taxes. Rates may not be used by groups or individuals attending conventions. See below for further terms and conditions which may apply.

HOTEL STAYS
Cancellation conditions are dependent upon the individual provider, ranging from charges for the first night to the full stay. Failure to check-in to the hotel as scheduled without prior notice of cancellation (no show) will result in no refund and the balance of any reservation will be cancelled and nonrefundable. No refunds will be given for early checkouts. Separate cancellation penalties or booking conditions may apply over holiday or special event periods and will be disclosed at the time of booking.

CAR RENTAL
No refund will be made for unused cars. Each car day purchased consists of a 24-hour period beginning when the car is picked up. If the rental car is returned beyond the number of days included in the package, additional charges may apply. Additional charges incurred must be paid directly to the rental car company. A valid driver's license will be required prior to renting a car, and the driver as indicated on the rental agreement must be 25 years of age or older.

AIRLINE TICKETS AND LUGGAGE
No cancellations or revisions. Airline tickets cannot be refunded, transferred or exchanged and are only valid on the dates and time indicated. Flights require a 72-hour confirmation. Travelers should confirm flights directly with airline.

Travelers are encouraged to contact their air carrier regarding specific baggage allowance. For flights to Cuba, travelers are typically permitted to check up to 44 pounds of baggage without charge (subject to change). Charges for excess baggage will be collected at the airport. For INTERNATIONAL flights, the air carrier's liability for lost or damaged bags is limited to the actual value of the baggage, but not more than amounts set forth in the Montreal Convention. Specifically, the air carrier's liability is limited to 1,331 Special Drawing Rights regardless of the number of checked bags. If, however, you declare a higher value for your baggage and pay an additional charge in advance, the air carrier's liability will be higher. You must submit your claim for lost or damaged baggage to the air carrier or within 3 days of the charter flight. Your claim must include a copy of the Baggage Check.

INTERNATIONAL FLIGHTS: The operation of the charter flight is subject to the Cuban government granting landing rights. If the air carrier cannot obtain landing rights, the flight will be cancelled, and a full refund will be made to you automatically.

INSURANCE: health and accident insurance is available. If you are interested in receiving more information about this coverage, please advise your travel agent or the AmericanTours International Help Desk.

TRAVEL DOCUMENTS
All travelers are responsible for obtaining valid travel documents, complying with customs, regulations, obtaining insurance and for making themselves aware of and complying with the laws of place to which they are traveling.

SANCTIONS/LICENSE REQUIREMENTS/FORM
Under current United States travel restrictions with respect to Cuba, travel related transactions are prohibited except for certain categories. By signing the travel affidavit, the travel advisory, the license requirements and other applicable forms, traveler declares that he/she is falling under the category indicated. Additional information in regards to the United States restrictions on travel to Cuba can be found at US Department of the Treasury's Office of Foreign Assets Control's (OFAC) website under http://www.treasury.gov/resource-center/sanctions/Programs/pages/cuba.aspx

The traveler must supply ATI with all required documentation before travel bookings can be confirmed. Traveler understands that ATI cannot be held liable for delays and/or losses in any and all cases where incomplete forms are returned by the traveler.

PAYMENTS: Full payment by traveler is due at time of reservation by Visa, MasterCard, Discover, or American Express. Travelers must be at least 18 years of age to make reservations.

REFUNDS: To transact a cancellation and refund (if applicable), please contact AmericanTours International's help desk. Refunds can only be made to the original credit card used. Failure to follow these instructions will result in loss or delay of refund. Unused room nights or partially used reservations are nonrefundable. Based on your credit card company's billing cycle, the credit may take 30 to 90 days to appear on your credit card statement.

HOTEL INFORMATION: Descriptions and locations of the properties found on this site are meant only as a guide to help you plan your vacation. Any maps shown are not drawn to scale. Room photographs shown are for informational purposes only and may not depict the actual category purchased. Hotel description, special features, amenities, dining and entertainment are based on information provided by the individual property and are subject to change without notice. Hotels may have certain restrictions regarding use and occupancy which you agree to abide by. ATI assumes no responsibility for cancellation or substitution of these features by the individual property.

NOT INCLUDED: Surcharges, resort fees, guest incidentals, telephone calls, gratuities, parking, meals, rollaway and/or child crib charges and any items of a personal nature.

VENDOR DOCUMENTS/VOUCHERS: Vendor documents are provided on a self-print basis and should be presented to the hotel front desk at time of check-in. Traveler must also be in possession of the original credit card used and a form of picture identification to ensure a smooth hotel check-in. Travelers unable to print hotel confirmation should take hand-written information and present it to the front desk at check-in.

COMPLAINTS: We provide a toll free telephone number should you have a complaint. Once we are notified of any valid complaint we will do everything possible to correct the problem. You acknowledge it is difficult to secure any kind of refund or compensation if we are not fully informed at the time of occurrence when the opportunity existed for the problem to be corrected.

RESPONSIBILITY AND LIMITATION OF LIABILITY: ATI arranges the services described on this site, including without limitation lodging that is provided by hoteliers, which are independent contractors and not the agents, employees, partners, or joint ventures of ATI. ATI issues documents for such travel services merely for the convenience of companies that furnish such services. Such travel documents are subject to all terms and conditions of the respective suppliers (some of which may limit or exclude the supplier's liability).

ATI shall not be responsible for any loss of or damage to property or death or injury to a person, resulting from any act or omission of any supplier providing any product or service or any other person or entity, or caused by strike, war, weather, act of god, quarantine, sickness, government restriction or regulation, or any other cause beyond ATI's control. Traveler expressly waives all rights he or she may have against ATI in connection with the foregoing.

Under no circumstances is ATI to be constructed as carriers under contract for safe carriage of the traveler or his or her baggage and belongings. If between planning time and the actual date of travel, circumstances beyond ATI's control require changes, ATI reserves the right to substitute components of any programs. Neither ATI nor its agents or cooperating organizations shall be responsible for any cancellations or for acts of any other service providers, diversions or substitution of hotels, or any other persons providing any of the services and accommodations to travelers. Nor shall they be liable for any loss or damage to baggage or property, or for injury, illness or death, or for any damages or claims whatsoever arising from any act, error, omission, default or negligence of any person not a direct employee or under ATI's exclusive control. The carriers, hotels and other suppliers who provide services are independent contractors and are not agents, employees or servants of ATI or their associated companies.

ATI is not responsible for any criminal conduct by third parties. In no event shall ATI have any liability to any person or entity beyond a refund of monies paid by traveler, less any cancellation or revision fees. All baggage and personal belongings are at all times carried at the traveler's own risk. Travel insurance is highly recommended.

ATI makes no warranties, guarantees or representation of any kind or implied, arising by law or otherwise, including without limitation any implied warranty of merchantability or fitness for a particular purpose, or any implied warranty arising from course of performance, course of dealing, or usage of trade.

Every effort is made to ensure website accuracy at the time of publication; however, ATI cannot be held responsible for printing or typographical errors, product changes and content changes on websites.

PHYSICAL DISABILITIES: ATI endeavors to support travelers with special needs. Please note that hotels and other service providers may not always have appropriate rooms or equipment readily available to accommodate specific requirements. If an ADA or handicapped accessible room is needed, please contact the ATI help desk during business hours, so that a special request may be sent to the vendor on your behalf for an ADA or handicapped accessible room. Please note that turnaround time on similar requests may be 24-48 hours as ATI needs to await a response from the service provider prior to confirmation. Availability for ADA rooms may be limited and some service providers assign ADA rooms on a first come, first serve basis only. In those instances ATI may not be able to confirm the special request but will advise accordingly.

SPECIAL REQUESTS: Adjacent rooms, connecting rooms, exact room locations, child cribs, roll-aways, types of rooms, or bedding such as queen, king and other special requests are on a "request only" basis, not guaranteed and subject to availability at hotel at time of check-in.

APPLICABLE LAW AND EXCLUSIVE JURISDICTION: You agree that all disputes arising in connection with your travel or these policies and procedures shall be brought before a court in the County of Los Angeles, State of California to the exclusion of the courts of any other state or country and shall be governed by California law without regard to conflict of law principles.

CHILDREN: Many hotels and attractions offer child discounts when accompanied by fully paying adults. Maximum occupancy and age requirements may vary by service.

The website, including these Terms and Conditions, represents the entire agreement between the traveler and ATI.
